1. What You're Agreeing To

By accepting this consent, you're giving NurseKind AI and your nursing school permission to:

Record your voice during practice sessions
Convert these recordings into written transcripts using secure transcription services
Analyze your communication using artificial intelligence to assess therapeutic communication skills
Generate feedback reports based on the NCSBN Clinical Judgment Measurement Model
Store this information securely for your educational use throughout your program
Share your assessment results with your assigned faculty and program administrators

2. What Information We Collect

We collect only the information necessary for your education:

4. Who Can See Your Information

People who CAN access your data:

You: Full access to all your recordings, transcripts, and feedback
Your Faculty: Can view your assessments to support your learning and assign grades
Your Program Administrators: Can see aggregated class data (not individual recordings) to evaluate program effectiveness
NurseKind AI Technical Staff: Limited access only when necessary for technical support or troubleshooting

People who CANNOT access your data:

Students from other schools
Faculty from other institutions
Marketing companies
Third-party advertisers
Anyone you haven't explicitly authorized

            FERPA Compliance: Your educational records are protected under the Family Educational Rights and Privacy Act (FERPA). Your school acts as the custodian of your data and must follow strict federal privacy laws.
        

5. Your Rights and Controls

You have the right to:

Access: View all your recordings, transcripts, and assessment results anytime
Download: Export your data in PDF format
Correct: Request corrections to inaccurate information in your records
Delete: Request deletion of specific recordings (subject to your school's record retention policies)
Revoke: Withdraw this consent at any time (though this may affect your ability to use the platform)
Complain: File a privacy complaint with your school or the U.S. Department of Education

6. How We Protect Your Information

How Long We Keep Your Data:

Active student records are retained while you're enrolled in your program
After graduation or withdrawal, your school determines the retention period (typically 3-5 years for educational records)
You can request early deletion of specific recordings at any time
Aggregated, de-identified data may be retained longer for research purposes (with no way to identify you)

7. Third-Party Services We Use

To provide our educational services, we work with trusted technology partners. These partners only process your data as needed to deliver the service and are bound by strict confidentiality agreements:

AssemblyAI: Converts audio recordings to text transcripts (FERPA-compliant, encrypted)
Google Vertex AI: Analyzes your transcript to generate clinical judgment and communication feedback (data not used for AI training; covered by our HIPAA Business Associate Agreement with Google Cloud)
OpenAI: Powers the optional AI voice-patient practice simulation only. No real patient information is involved — the simulation uses a fictional patient, and OpenAI does not use this data for AI training
Google Cloud SQL: HIPAA-compliant PostgreSQL database hosting — Business Associate Agreement on file
Firebase Authentication (Google LLC): Sign-in and secure data delivery — Business Associate Agreement on file

            Important: All third-party partners have signed data processing agreements that prohibit them from using your data for any purpose other than providing our educational service.
        

8. Changes to This Consent

If we need to change how we handle your data, we will:

Notify you by email at least 30 days before the changes take effect
Clearly explain what's changing and why
Give you the option to withdraw consent if you don't agree with the changes
Not apply changes retroactively to data already collected under previous terms

9. HIPAA-Compliant Data Handling

HIPAA Compliance: NurseKind AI is fully HIPAA-compliant and operates under appropriate Business Associate Agreements with all data processors. Any Protected Health Information (PHI) collected through the platform is handled in accordance with the HIPAA Privacy Rule (45 CFR Part 164) and Security Rule safeguards — including AES-256 encryption at rest and in transit, role-based access controls, and tamper-evident audit logging.

If your practice sessions involve real patient interactions, ensure you have obtained appropriate patient authorization as required by your institution's policies and applicable law.
