NurseKind AI - Student Data Privacy & Usage Agreement

📋 Quick Summary (Read This First)

What we're asking: Your permission to record and analyze your nursing communication practice sessions to help you develop better clinical communication skills.

What we collect: Transcripts of your recorded sessions and the scores and feedback we generate. The audio itself is deleted once it has been transcribed
Why we collect it: To give you personalized feedback on your therapeutic communication and empathy skills
Who sees it: You; the instructors who added you or teach a course you are in; your school's administrators; and, for a group recording you took part in, the other students in that group. A small number of NurseKind staff can open records for support and security only. Every staff access is logged, and both you and your school can see it
What we DON'T do: We never sell your data, use it for advertising, or share it with anyone other than your school and the service providers that process it for us (listed on our Subprocessors page)
Your rights: You can review and download your data anytime, see who has accessed it, ask for a correction, and ask your school to delete it

            HIPAA Compliance: NurseKind AI maintains HIPAA-compliant security safeguards. All data is also protected under federal education privacy law (FERPA).
        

1. What You're Agreeing To

By accepting this consent, you're giving NurseKind AI and your nursing school permission to:

Record your voice during practice sessions
Convert these recordings into written transcripts using secure transcription services
Analyze your communication using artificial intelligence to assess therapeutic communication skills
Generate feedback reports based on the NCSBN Clinical Judgment Measurement Model
Store this information securely for your educational use throughout your program
Share your assessment results with your assigned faculty and program administrators

2. What Information We Collect

We collect only the information necessary for your education:

            Privacy Protection: Your recordings are encrypted during upload and storage. We use industry-standard security measures to protect your educational records.

Measuring your progress against NCLEX standards and NCSBN Clinical Judgment Model
Helping your instructors understand class-wide learning patterns
Generating reports for your faculty to support your education
Improving the platform to better serve nursing students

What We Will NEVER Do:

❌ Use your data for advertising or marketing
❌ Share your information with companies other than your school and the service providers that process it for us, without your explicit permission
❌ Create profiles of you for commercial purposes
❌ Use your data to train AI models that benefit other companies

4. Who Can See Your Information

People who CAN access your data:

You: Full access to all your recordings, transcripts, and feedback
Your Faculty: Can view your assessments to support your learning and assign grades
Your Program Administrators: Can see aggregated class data (not individual recordings) to evaluate program effectiveness
NurseKind AI Technical Staff: Limited access only when necessary for technical support or troubleshooting

People who CANNOT access your data:

Students from other schools
Faculty from other institutions
Marketing companies
Third-party advertisers
Anyone you haven't explicitly authorized

            FERPA Compliance: Your educational records are protected under the Family Educational Rights and Privacy Act (FERPA). Your school acts as the custodian of your data and must follow strict federal privacy laws.
        

5. Your Rights and Controls

You have the right to:

Access: View all your recordings, transcripts, and assessment results anytime
Download: Export your data in PDF format
Correct: Request corrections to inaccurate information in your records
Delete: Request deletion of specific recordings (subject to your school's record retention policies)
Revoke: Withdraw this consent at any time (though this may affect your ability to use the platform)
Complain: File a privacy complaint with your school or the U.S. Department of Education

How to Exercise Your Rights:

To access or download your data: Log into your account and use the export features
To request corrections or deletion: Contact your faculty administrator or email hi@nursekindai.com
To withdraw consent: Email hi@nursekindai.com with "Withdraw Consent" in the subject line

6. How We Protect Your Information

Security Measures:

End-to-end encryption for all audio uploads and data at rest (AES-256)
HIPAA-compliant access controls and role-based permissions
Tamper-evident audit logs retained per HIPAA §164.312(b)
Multi-factor authentication required for all administrative and faculty accounts
Regular security risk assessments per HIPAA §164.308(a)(1)
Secure cloud storage with regular backups

How Long We Keep Your Data:

Assessment, practice-session and group records are permanently deleted one year after they were created, whether or not you are still enrolled (a record with an open correction request is kept until the request is resolved)
Audio is deleted as soon as it has been transcribed; only the transcript is kept
If your instructor uploads a video of a session you took part in, they confirm that everyone in it consented. The video can show your face and voice. It may be analyzed by AI for observable behaviors such as posture, attention and appearance and, if your instructor chooses, for the steps of a skill you perform, such as hand hygiene, vital signs, medication administration, sterile technique or Foley catheter, or a skill your instructor has defined. These are observations for your instructor to review, not a score or a grade. They are not shown to you in the app, they are included if you download your records, and we do not identify you from your face. The video is deleted as soon as the analysis finishes. It is never kept for playback
If your school ends its agreement with NurseKind, its student records are permanently deleted 30 days later
You can ask your school to delete your records earlier at any time

7. Third-Party Services We Use

To provide our educational services, we work with trusted technology partners. These partners only process your data as needed to deliver the service and are bound by strict confidentiality agreements. See our Subprocessors page for the current, complete list of vendors, what each processes, where, and its HIPAA BAA / GDPR DPA status.

            Important: All third-party partners have signed data processing agreements that prohibit them from using your data for any purpose other than providing our educational service.
        

8. Changes to This Consent

If we need to change how we handle your data, we will:

Notify you by email at least 30 days before the changes take effect
Clearly explain what's changing and why
Give you the option to withdraw consent if you don't agree with the changes
Not apply changes retroactively to data already collected under previous terms

9. HIPAA-Compliant Data Handling

HIPAA Compliance: NurseKind AI is fully HIPAA-compliant and operates under appropriate Business Associate Agreements with all data processors. Any Protected Health Information (PHI) collected through the platform is handled in accordance with the HIPAA Privacy Rule (45 CFR Part 164) and Security Rule safeguards — including AES-256 encryption at rest and in transit, role-based access controls, and tamper-evident audit logging.

If your practice sessions involve real patient interactions, ensure you have obtained appropriate patient authorization as required by your institution's policies and applicable law.
